Si le bonheur exige la solitude, il est toujours hanté par l’altérité ; si sa source est en soi-même, il ne cesse toutefois de dépendre de circonstances contingentes ; et si, enfin, il s’éprouve tout entier dans le sentiment, il s’agit pourtant d’un sentiment augmenté d’un caractère réfléchi ou, pour mieux (...) dire, redoublé dans le souvenir que retrace l’écriture. Dans tous les cas, ces antinomies du bonheur – sur lesquelles nous reviendrons longuement plus loin – s’enracinent dans une marqueterie de références dont l’hétérogénéité est l’expression d’un dialogue tendu au sein duquel, comme nous souhaiterions d’abord le montrer, la philosophie morale des Anciens se réinvente en adoptant le langage, éminemment moderne, du sentiment. In July 1759 the French philosopher Andre´ Pierre Le Guay de Prémontval (1716-1764) published in Berlin a diatribe against the excessive and incorrect use of French in the Prussian capital. Far from being a mere guide to linguistic style, the Préservatif contre la corruption de la langue françoise generated a heated debate, attested by an official threat to ban its publication. The personal animosity between Prémontval and the perpetual secretary of the Berlin Academy, Jean Henri Samuel Formey (1711-1797) was (...) amply demonstrated over the pages of the Préservatif, offering a rare insight into the complex web of social and intellectual tensions in mid eighteenth-century Berlin and its Academy of Sciences. At stake were the social status and the philosophical outlook of local Huguenots, compared to that of French philosophers who were granted asylum in Prussia by Frederick II. The debate also concerned the issues of academic freedom in an absolutist regime, the material production and distribution of texts, conduct and etiquette in the Republic of Letters and the formation of group identities in eighteenth-century Germany. Drawing on manuscripts preserved in Berlin, Göttingen and Krakow, this article traces the development of the controversy and the reception of Prémontval’s work by both French- and German- writing authors at the Berlin Academy and beyond its confines. Over the last thirty years, once staunchly historical cinema scholars such as Thomas Elsaesser, Jane Gaines, Siegfried Zielinski, and André Gaudreault have abandoned history for historiography and film studies for media archaeology. With increasing attention on the “database” as a symbolic metaphor for postmodernity and the decentered, networked tenants of the global present, cinema is taking on the characteristics of new media, existing in intertextual space. Thus, the term “post-cinema” has been co-opted as a viable intermediary that accounts for new (...) media conditions, as cinema is no longer emblematic of our cultural climate. As Giorgio Agamben wrote in 1992, “[t]he end of the cinema truly sounds the death knell of the ultimate metaphysical adventure of Dasein. In the twilight of post-cinema…human quasi-existence, now stripped of any metaphysical hypostasis and deprived of any theological model, will have to seek its proper generic consistency elsewhere." Accordingly, we are no longer “moviegoing animals” who seek images of ourselves among a collective in the dark but, rather, users interfacing within a network of moving images. (shrink)

According to the transparency thesis, some conscious states are transparent or “diaphanous”. This thesis is often believed to be incompatible with an inner‐awareness account of phenomenal consciousness. In this article, I reject this incompatibility. Instead, I defend a compatibilist approach to transparency. To date, most attempts to do so require a rejection of strong transparency in favor of weak transparency. In this view, transparent states can be attended to by attending (in the right way) to the presented world: that is, (...) they are merely translucent. Here, I first argue that this understanding of transparency is too weak to qualify as a compatibilist view. Drawing on insights from Franz Brentano, I then describe a middle road between strong and weak transparency. The crucial idea is that, although transparent states cannot be attended to, they can be noticed (under suitable conditions). This view, I submit, allows supporters of inner awareness to commit themselves to a more interesting understanding of transparency—moderate transparency—that preserves the initial intuition underlying the transparency metaphor. This article argues that Brentano’s classification of mental phenomena is best understood against the background of the theories of natural classification held by Auguste Comte and John Stuart Mill. Section 1 offers a reconstruction of Brentano’s two-premise argument for his tripartite classification. Section 2 gives a brief overview of the reception and historical background of the classification project. Section 3 addresses the question as to why a classification of mental phenomena is needed at all and traces the answer back to (...) Mill’s view that psychological laws are class-specific. Section 4 and 5 connect the second premise of Brentano’s argument to Comte’s principle of comparative likeness and Mill’s insistance that class membership is determined by the possession of common characteristics. This chapter argues that Gilbert Ryle’s account of misleading expressions, which is rightly considered a milestone in the history of analytic philosophy, is continuous with Brentano’s. Not only did they identify roughly the same classes of misleading expressions, but their analyses are driven by a form of ontological parsimony which sharply contrasts with rival views in the Brentano School, like those of Meinong and Husserl. Section 1 suggests that Ryle and Brentano share a similar notion of analysis. Section 2 spells (...) out the notion of misleading expression by means of the surface-grammar/truth-conditions distinction, which I argue is implicit in their accounts. Section 3 zooms in on a specific class of misleading expressions, namely expressions about ficta. Finally, Section 4 draws the consequences of what precedes for a correct understanding of the notion of meaning. (shrink)

Given the importance of the principle of causality for the demonstration of God’s existence, this paper attempts to justify the evidence and necessity of the principle of causality, by following Fr. Fabro’s Thomistic defense—based on the notion of participation—but adding a particular emphasis on the notion of “being which is not per se,” this latter as an explanatory notion of the notion of “being which is by participation.” The introductory remarks touch upon two misunderstandings regarding the notion of participation employed (...) as a subject of the principle of causality: the first, considering “participated being” as a synonym of “received being,” and the second, the confusion, regarding the notion of being by participation, between its notional dependence on the notion of being as a whole and its real dependence on the real intensive Being. Then, in the first point, the defense of the principle of causality is distinguished from other related problems, like the particular applications of this principle. In the second and main point, we try to justify the necessity of being caused in the being which is experienced as being by participation, as follows: 1) that which is something by participation is not this something per se; 2) now, that which is not per se, either is not or is per aliud, 3) Therefore, that which is something by participation is per aliud. In the third and last point, we endeavor to justify the Thomism of our defense and of our emphasis on this notion of “being which is not per se” by considering two texts of St. Thomas. (shrink)

These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). To Occamize a nominal expression N is to show that, despite grammatical appearances, N does not name, or denote, an entity. This article argues that the Occamization of ‘meaning,’ which was central to Gilbert Ryle’s meta-philosophy, had already been advanced by Franz Brentano. The core thesis of the article is that Brentano’s notion of ‘content,’ albeit different from that of linguistic rules, does a similar job of eliminating expendable entities. If the meaning of a linguistic expression is not an entity (...) at all, then the question as to what kind of entity it is—what I shall call the Locke-Frege problem—turns out to be a pseudo-problem and is better dispensed with. This chapter offers a phenomenological interpretation of Brentano’s view of mentality. The key idea is that mental phenomena are not only characterized by intentionality; they also exhibit a distinctive way of appearing or being experienced. In short, they also have a distinctive phenomenology. I argue this view may be traced back to Brentano’s theory of inner perception. Challenging the self-representational reading of IP, I maintain the latter is best understood as a way of appearing, that is, in phenomenological terms. Section (...) 1 addresses Brentano’s claim that IP is one mark of the mental alongside intentionality. Sections 2 and 3 present support for a phenomenological interpretation of IP. Franz Brentano’s works are not just full of deep and innovative insights into mind, world and values. His views also turned out to be highly influential upon several generations of students, who made them the basis of their own philosophical investigations, giving rise to what is known as the Brentano School (Albertazzi et al. 1996; Fisette & Fréchette 2007). In this chapter, I give a bird’s eye view of the Brentano School from a rather historical perspective. My leading hypothesis is (...) that one crucial factor explaining the rise of the school is Brentano’s unique strategy, within the academic context of the time, to promote the revival of philosophy as a rigorous science. After a brief introduction, I reconstruct the three main phases in the school’s development, namely Brentano’s teaching in Würzburg (1866-73), his teaching in Vienna (1874-95), and Anton Marty’s teaching in Prague (1880-1913). In this paper, we apply the perspective of intra-organismal ecology by investigating a family of ecological models suitable to describe a gene therapy to a particular metabolic disorder, the adenosine deaminase deficiency (ADA-SCID). The gene therapy is modeled as the prospective ecological invasion of an organ (here, bone marrow) by genetically modified stem cells, which then operate niche construction in the cellular environment by releasing an enzyme they synthesize. We show that depending on the chosen order (a choice that cannot (...) be made on \textit{a priori} assumptions), different kinds of dynamics are expected, possibly leading to different therapeutic strategies. This drives us to discuss several features of the extension of ecology to intra-organismal ecology. (shrink)

Fabro acerca de la dependencia causal como exigencia del ser participado, a través del estudio de algunas de sus obras más importantes al respecto. Buscamos respondernos por qué para el p. Fabro el ser participado exige una causa, y valorar sus argumentos. -/- Como hemos dicho, para nuestro trabajo nos valdremos ante todo del estudio de algunas de las obras más importantes del p. Cornelio Fabro con respecto a la causalidad. Nos referimos en concreto a tres de ellas: la primera, el artículo La difesa critica del principio di causa, donde el autor expone de un modo preciso la noción de participación como el fundamento de la justificación crítica del principio de causalidad. Did we get Aquinas’ Epistemology right? St. Thomas is often interpreted according to Kantian principles, particularly in Transcendental Thomism. When this happens, it can appear as though Aquinas, too—along with Kant—had made the “turn to the subject”; as if Aquinas were no longer the Aristotelian “believer” who thinks nature is what it is but, instead, the Kantian “thinker” who holds that nature is what we think of it; as if St. Thomas, like Kant, had concluded that nature is intelligible not (...) only when we think of it, but because we think of it. After much struggle with this problem, the challenge seemed obvious to me: to show the radical difference between Aquinas and Kant. Kant had reasons to make his turn, his Copernican revolution. Could I explain those reasons, could I pinpoint the problem leading Kant to think in those terms? Could I show Aquinas facing the same problem and clearly taking a different direction in his proposed solution? That is what I have tried to do in this book. This book provides an interpretation of Aquinas’ agent intellect focusing on Summa Theologiae I, qq. 75-89, and proposing that the agent intellect is a metaphysical rather than a formal a priori of human understanding. A formal a priori is responsible for the intelligibility as content of the object of human understanding and is related to Kant’s epistemological views, whereas a metaphysical a priori is responsible for intelligibility as mode of being of this same object. We can find in Aquinas’ text many indications that the agent intellect is not productive of the intelligible object but is, rather, productive of the abstracted or intelligible mode of being of this object. This is because for Aquinas the universal as nature, which is the object of human understanding, is present in the things themselves but with a different mode of being. In this four-chapter book, Chapter 1 is intended to establish the fact which requires for Aquinas an agent intellect, and provides two very important principles: one is that the object of human understanding (the universal as nature) is present in the things themselves and, the other, that it is not in the things themselves with a mode of being which makes it available to the intellectual eye. These two principles lead us to the main point of Chapter 2, namely the distinction between the intelligible object and its intelligible mode of being. Now, because knowing is receptive of the intelligible object (Chapter 3), which is present in the things themselves (Chapter 1), the agent intellect is productive not of the object’s intelligible content, but of its abstracted or intelligible mode of being (Chapter 4). In this paper, I examine the problem of Bayle's skepticism. I show that he is not a wholesale skeptic. Rather, he thinks that reason is plagued by internal conflicts. But its principles, which clash with each other, can be adopted separately from each other. It is often what we have to do when dealing with metaphysical problems. This also entails that reason is not to be rejected as a whole when it happens to be contradicted by faith; only some of (...) its principles have to be denied, and solely in that case. Further, Bayle believes that we possess absolute certainly in our knowledge of ethical principles. I show how this is compatible with his relativism in other domains by putting back his contention in the context of Reformed thought. (shrink)

In this paper, we discuss the perspective of intra-organismal ecology by investigating a family of ecological models. We consider two types of models. First order models describe the population dynamics as being directly affected by ecological factors (here understood as nutrients, space, etc). They might be thought of as analogous to Aristotelian physics. Second order models describe the population dynamics as being indirectly affected, the ecological factors now affecting the derivative of the growth rate (that is, the population acceleration), possibly (...) through an impact on non-genetically inherited factors. Second order models might be thought of as analogous to Galilean physics. In the joint paper, we apply these ideas to a situation of gene therapy. (shrink)

Call metaphysical optimism the view that this world is the best of all possible worlds. This article addresses Franz Brentano’s case for metaphysical optimism. I argue that, although Brentano does not offer any conclusive argument in favour of the latter, he disentangles many related issues which are interesting in their own right. The article has five sections corresponding to five claims, which I argue are central to Brentano’s view, namely: metaphysical optimism is best spelled out as the view that this (...) world is the only good among all possible worlds; the notion of “correct”—or “fitting”—love offers a criterion of the good and the test of inverted love offers a means to identify that which is good; pessimism has to be distinguished from pejorism, viz. the view that the non-existence of this world is preferable to its existence; there is something good involved in every “bad” thing, to the effect that pejorism is false; it is wrong to consider the value of something in isolation. This paper offers a reconstruction of Franz Brentano’s mereological solution to the problem of the unity of consciousness and explores some implications of this solution for the ontology of the mind. In section 1 I sketch Brentano’s ontological distinctions between things, collectives, and divisives. In section 2 I present Brentano’s mereological solution and in section 3 I review his main pro-arguments. Eventually, in section 4 I consider some Jamesian objections to the mereological approach. I argue the notion of ‘mental parts’ (...) can be given a rather innocuous meaning by being conceived of as the expression of conceptual distinctions grounded in similarity and contrast relations between total mental phenomena. In this article I want to create a presumption in favor of a nonreductive analysis of emotional phenomenology. The presumption relies on the claim that none of the nonemotional elements which are usually regarded as constitutive of emotional phenomenology may reasonably be considered responsible for the evaluative character of the latter. In section 1 I suggest this is true of cognitive elements, arguing that so-called ‘evaluative’ judgments usually result from emotional, evaluative attitudes, and should not be conflated with them. This article compares and contrasts the reception of Comte’s positivism in the works of William Whewell, John Stuart Mill and Franz Brentano. It is argued that Whewell’s rejection of positivism derives from his endorsement of a constructivist account of the inductive sciences, while Mill and Brentano’s sympathies for positivism are connected to their endorsement of an empiricist account. The mandate of the article is to spell out the chief differences between these two rival accounts. In the last, conclusive section, Whewell’s (...) anti-positivist argument is briefly assessed, and rebutted. (shrink)

This article argues that Meinong’s analysis of assumption, while exploring the variety of phenomenological primitives in a more promising way than Brentano did, nevertheless fails to adequately account for the noncommittal character of assumptive attitudes and the difference between assumptive and other neighbouring attitudes. Section 1 outlines an overall framework for the philosophical analysis of assumptions and cognitive attitudes. Section 2 gives an overview of Brentano’s analysis of cognitive attitudes and some difficulties thereof. Section 3 offers a critical examination of (...) Meinong’s rival analysis. Eventually, Section 4 suggests an alternative route, according to which assumptive attitudes are best analysed in taking as a phenomenological primitive besides. (shrink)

Misophonia is a disorder of tolerance to specific sounds (i.e. trigger sounds), such as chewing, throat clearing or breathing sounds, produced by humans, which can trigger intense emotional reactions (anger, disgust). This relatively prevalent disorder can cause a reduction in the quality of life. The causes of misophonia are still unclear. In this article, we develop a “social” hypothesis based on the work of Norbert Elias. Misophonia would be an exaggerated reaction to behaviours (of others) that have been subject to (...) rigorous social conditioning, which are supposed to be strictly regulated and repressed. The social rules imposed by society, accompanying the long process of pacification and increasing interdependence between individuals over the centuries, would be at the origin of this conditioning. The function of this conditioning, achieved mainly through shame and disgust, would be to preserve social cohesion, through the strict training of behaviour. It is indeed imperative to control oneself, to act in a thoughtful and balanced way, to spare others by taking into account their expectations, in short to behave in a “courteous” way. Imposed and less spontaneous behaviour creates a sense of modesty and distance between individuals. The obligation to strictly regulate behaviour and affect in public contributes to the creation of an interiority, an "inner self". The feeling of intrusion by others is a collateral effect of this process of distancing and individualisation. The rigorous integration of the social rule by the misophonic subject may account for the fact that any violation of the rule is considered unacceptable. In order to put an end to the unpleasant situation, i.e. to the intrusion generated by the “encroachment” of others, the subject has no other choice but to flee or to attack the author of the sound. In this research I present a study on the origin of alienism in the 19th century in the work of Phillipe Pinel in context. The purpose of the paper is to show how the French physician proposes alienism inspired by the anthropological ideas of his time. After the introduction, a brief historical overview of the anthropology of modernity is given to place Pinel's work in context. This is followed by a survey of Pinel's anthropological ideas, which are in a sense (...) coincident with his period. Finally, it is presented how Pinel proposes his famous alienism, situated between the understanding and the affected life, as well as the way of curing his patients as a consequence of his anthropological approach. Physical reality is all the reality we have, and so physical theory in the standard sense is all the ontology we need. This, at least, was an assumption taken almost universally for granted by the advocates of exact philosophy for much of the present century. Every event, it was held, is a physical event, and all structure in reality is physical structure. The grip of this assumption has perhaps been gradually weakened in recent years as far as the sciences of (...) mind are concerned. When it comes to the sciences of external reality, however, it continues to hold sway, so that contemporary philosophers B even while devoting vast amounts of attention to the language we use in describing the world of everyday experience B still refuse to see this world as being itself a proper object of theoretical concern. Here, however, we shall argue that the usual conception of physical reality as constituting a unique bedrock of objectivity reflects a rather archaic view as to the nature of physics itself and is in fact incompatible with the development of the discipline since Newton. More specifically, we shall seek to show that the world of qualitative structures, for example of colour and sound, or the commonsense world of coloured and sounding things, can be treated scientifically (ontologically) on its own terms, and that such a treatment can help us better to understand the structures both of physical reality and of cognition. I first explain the scholastic (Scotist) thesis on the independence of essences Bayle alludes to in the passage of the Continuation des Pensée Diverses where he presents the Stratonicians' and the Chinese philosophers' retorsion. Then, I show that this retorsion applies to the argument of the existence of God based on "aseity", but not to the occasionalist argument based on the "quod nescis" principle. I conclude that materialism (the "Stratonician hypothesis") cannot be, for Bayle, a satisfying system.

Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

The probability calculus is very often used in the philosophy of science in order to support or to analyse epistemological points of view. The aim of this paper is to present in a summary the usual axioms of this calculus, as weIl as its most common consequences and theorems, which the philosopher of science in his arguments ressorts to.

Compared to the existing bibliographies devoted to Paul Mansion, this list of his written and spoken words increases the number of items pertaining to the Annales de la Société scientifique de Bruxelles from 123 to 208, and from 32 to 142 for those pertaining to the Revue des questions scientifiques, thus representing an increase of 40% and 77%, respectively. Based directly on an analysis of these two journals themselves, it makes the relevant bibliographical information — contained both in these earlier (...) bibliographies and in the analytical indexes devoted to these journals — accessible to researchers in a more accurate, convenient and comprehensive manner. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

El artículo expone el papel del otro y de lo otro en la hermenéutica de Gadamer a la luz de la idea de diálogo. Para comprender se requiere reconocer lo otro en su carácter de tú, asumir que no se tiene distancia frente a él y estar abierto a acoger lo dicho por él como una posible verdad. La compresión posee una estructura dialéctica que implica la cancelación de las propias expectativas y el acceso a un saber más abarcante. Aunque (...) la comprensión es histórica, en ella se muestra cada vez un aspecto de la cosa misma, que resulta de la interacción del yo y el tú en el curso de la conversación hermenéutica y que constituye una verdad común con caracteres análogos a los del saber de tipo práctico. [The paper exposes the role of the other in Gadamer’s hermeneutics in the light of the idea of dialogue. Understanding requires the recognition of the other as a thou, the acceptance of the lack of distance from him and the openness to embrace what is said by him as a possible truth. Understanding has a dialectical structure which implies the cancellation of one’s own expectations and the access to a more comprehensive knowledge. Margaret Urban Walker argues that hospital ethics committees should think of their task as "keeping moral space open." I develop her suggestion with analogies: Enlarge the windows (i.e., expand what counts as an ethical issue); add rooms and doors (i.e., choose particular issues to engage). Examples include confidentiality defined as information flow, and moral distress in the healthcare workplace.

In a world of more than 7 billion people, 80% live on less than $10 per day. Five (5) percent of global income is generated by the poorest 40 percent of the world’s population; while the wealthiest 20% of the population generates 75 percent of world income. Economics attempts to define or describe behavior and it ventures into the realm of predicting. Economics should therefore accept responsibility for controlling/directing realities. If we can understand, define and predict behavior, we should accept (...) the responsibility for changing behavior, and as economists, bring that to bear on material upliftment of the greater majority of the earth’s populace. . Since 1847, numerous role-players have debated and worked tirelessly to promote the welfare of those who are marginalised from mainstream society. To what avail? Exactly one hundred and fifty eight years later, one of the iconic statesmen of the twentieth century, Nelson Mandela, stated: “Massive poverty and obscene inequality are such terrible scourges of our time – times in which the world boasts breathtaking advances in science, technology, industry and wealth accommodation – that they have to rank alongside slavery and apartheid as social evils” (as quoted in Green 2009:2).Clearly, significant progress in addressing the issue has not been made. A concerted drive by the United Nations led to the adoption of the Millennium Development Goals in September 2000, and was endorsed by 189 world leaders. Some progress has been made during the past decade, but it is apparent that many countries are not going to be able to reach their goals. Hence, in order to address poverty at its root, attention is increasingly focused on the contribution of the informal sector and small, medium and micro enterprises. This paper explores such and offers alternatives to combat the spectres of structural unemployment and poverty. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. Deux idées centrales sont défendues dans cet article. La première concerne les liens entre les concepts de matérialisme émergentiste et de réalisme critique dans la métaphysique bungéenne. Je défends la thèse que le réalisme critique bungéen doit intégrer épistémologiquement celui de matérialisme afin de se développer en tant que doctrine méthodologique. J’y analyse ce que je considère être les fondements de la méthode de la construction de cette même métaphysique, soit l’affirmation du postulat de l’extériorité du monde concret et son (...) rôle dans la méthode en question. La seconde thèse a pour objet une analyse de cette méthode au moyen de l’étude que j’y fais des concepts ontologiques bungéens d’objet, de substance et de propriétés objectales. Je compare ensuite cette méthode à certains aspects de la philosophie des mathématiques et en particulier au rôle attribué dans cette même philosophie à la méthode axiomatique en tant que méthode de construction théorique et de preuve. Je conclus en une certaine circularité de l’argument qui justifie le réalisme critique à partir du postulat ontologique de l’extériorité du monde concret. (shrink)

Why I thought it useful to offer an explanation of Hegel’s doctrine on the Incarnation was so that the reader may be empowered to identify Hegel’s influence in modern accounts of this mystery. Even if, in my view, Hegel’s interpretation of revealed religion differs greatly from Catholic Doctrine, it is not surprising to find the presence of some of his concepts in modern theology. In truth, what matters is not the theologian’s self-identification as Hegelian or as non-Hegelian, but whether or (...) not the theologian adopts Hegel’s concepts. This paper offers an explanation of the internal dynamism of Hegelian concepts and their relation to Christian doctrine in Hegel’s Phenomenology of Spirit. This research may help to show in what way it is possible to explain Christian religious doctrine with a philosophy other than the Thomistic one and how, at least in Hegel’s case, religious doctrine is changed and reduced to an erroneous philosophical content. Also, an attempt is made to show the internal “coherence” of this Hegelian re-reading of Christianity so that theologians may become more cautious about accepting an explanation of Christian doctrine simply because the Christian language is preserved in that explanation. Inicialmente se caracteriza una noción de explicación que hace referencia a las creencias y fines epistémicos de los miembros de una comunidad científica. Posteriormente se demuestra que la inclusión de los aspectos pragmáticos de la explicación en la teoría no sólo no conduce al relativismo, sino que es necesaria para poder dar cuenta de la (...) relación entre las nociones de explicación y comprensión. There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. Le scientisme a plus de notoriété que l’histoire proprement dite, car il a été identifié avec le « positivisme », le « réductionnisme », le « matérialisme » ou le « marxisme », ou même tenu responsable de la domination de la science sur leur autres activités humaines. L’idée que la recherche scientifique produit les meilleures connaissances possible réside dans la définition même du « scientisme ». Cependant, alors même que la science peut se prévaloir d’un nombre considérable de succès (...) théoriques et pratiques, une confiance rationnelle envers elle comme moyen de résoudre tout problème factuel a été dénoncée comme illégitime, discutable ou dogmatique. Ainsi, après avoir passé en revue les diverses conceptions du scientisme, je défends une position raisonnable du scientisme contre certaines de ses critiques dominantes. Ainsi, on soutiendra que la science est l’approche la plus fiable pour acquérir des connaissances sans nuire à d’autres activités importantes dans la mesure où celles-ci ne traitent pas de questions factuelles ou cognitives ni ne sont en contradiction avec une vision du monde scientifique. Following Michael S. Jones’ call for articles showing the contemporary value of the great 20th century Romanian philosopher Lucian Blaga in various spheres of expertise, I have immediately thought of George F. Steiner’s recently published book, Neanderthals in Plato’s Cave. The evolutionary model forwarded by Steiner draws heavily on philosophical insights provided by Blaga and, although the volume was written for a scientifically-minded public, the author has adopted, updated and expanded some of Blaga’s anthropological perspectives. In our e-mail correspondence, Steiner (...) has acknowledged Blaga’s influence and has enthusiastically endorsed my attempt to review the similarities between some of the postulates of contemporary research in the various disciplines that inform cognitive archaeology – Steiner’s field of expertise – and the conceptual evolutionary/cultural hypothesis outlined in Blaga’s philosophical system. : New genetic technologies continue to emerge that allow us to control the genetic endowment of future children. Increasingly the claim is made that it is morally "irresponsible" for parents to fail to use such technologies when they know their possible children are at risk for a serious genetic disorder. We believe such charges are often unwarranted. Our goal in this article is to offer a careful conceptual analysis of the language of irresponsibility in an effort to encourage more care (...) in its use. Two of our more important sub-claims are: A fair judgment of genetic irresponsibility necessarily requires a thick background description of the specific reproductive choice; and there is no necessary connection between an act's being morally wrong and its being irresponsible.
